Disputes About Superannuation

Superannuation disputes concern 2 issues.

  • failure to pay insurance entitlements that are payable as part of superannuation arrangements; and
  • disputes about payment of death benefits.

Many superannuation funds provide total and permanent disablement insurance. Often disputes will arise about whether a person is entitled to make a claim. If your claim is improperly rejected you can challenge that decision at the Australian Financial Complaints Authority.

When a person dies their superannuation funds can be distributed in various ways and the Trustee of the Superannuation Fund will decide how the funds will be distributed. Disputes can arise because sometimes superannuation funds will be distributed in ways that were not expected. If you disagree with what the Trustee decides to do you can challenge this decision at the Australian Financial Complaints Authority.
