Dear Colleagues!
I handle a lot of matters at the FOS. In one matter, an issue has arisen about jurisdiction. Despite not giving me an opportunity to respond, the FOS has decided that it does not have jurisdiction (on grounds that would appear to be clearly spurious). This is annoying but what is more annoying is that the FOS’ decision was based upon submissions (made by a major financial services participant) that I was not provided with a copy of before the decision was made. The submissions (in the form of a letter) are addressed as Dear Colleagues – I think we can all draw our own conclusions from these events as to why fundamental changes are required to EDR.
